Recognition of a state is an act of one or more states that accept a certain creation in the international community as a state. The basic rule that in order for a state to emerge, it is necessary to possess territory, population and sovereign power over that territory and population. There is an opinion that recognition is necessary for the creation of the state as the fourth element. The paper will prove that the recognition of the state is a declaratory act, of a political nature that has no constitutive effect in the creation of the state. It will also point out the great importance of the recognition of the state, as well as the possible abuse of this institute. Other aspects of state recognition will be analyzed in order to prove its exclusively declarative political character.
